Justice Moses Mukiibi of the High Court (Masaka) has dismissed a case where a Kampala businessman, Godfrey Kato-Kajubi was accused of murder.

Kajubi was accused of killing a 12-year-old boy, Joseph Kasirye, in a suspected ritual sacrifice for wealth.

Joseph Kasirye was killed at Kayugi village in Masaka district on October 27, 2008.

The judge said all the 22 prosecution witnesses failed to pin Kajubi on the grisly murder.

The prosecution witnesses included Kateregga and his wife Mariam Nabukeera.

 Kateregga and Nabukeera were the only eye-witnesses to the horrific murder.

The two key witnesses in Kasirye’s murder case had originally been indicted with Kajubi but the Director of Public Prosecutions turned them into state witnesses.

Justice Mukiibi acquitted the suspect arguing that the prosecution had failed to produce incriminating evidence against Kajubi. 

The judge said the court could not rely on Kateregga’s testimony as an eye-witness because his statements were not well-coordinated.
