Justice Mwondha dismisses Kaddu Mukasa election petition

High Court in Kampala has dismissed an election recount petition filed by James Makumbi against the victory of Jerome Kaddu Mukasa in the Mityana North parliamentary seat.

Makumbi says Mukasa won the February 18th 2011 elections through a wrong process by the Electoral Commission who did not properly count the votes from all polling stations.

But Justice Faith Mwondha of Nakawa High Court dismissed the petition saying the time allowed by the law to file and hear such petition expired more than two weeks ago.

She says her court cannot guarantee the safe custody of the ballot boxes which are reported to have been kept at the home of the district returning officer for some time before they were brough to police for safe custody.

Kaddu Mukasa was represented by Lukwago and Company advocates, while James Makumbi was represented by Kizige and Company Advocates.

Makumbi who competed as a candidate for the ruling National Resistance Movement insisted after the ruling that the vote results announced by the Electoral Commission were not the true results of the elections.

Justice Mwondha advised the petitioners to appeal to the Court of Appeal if they are not satisfied with her decision.
