Kampala High court has asked the Electoral Commission to avail the former Lubaga North Parliamentary candidate Moses Kasibante with the two sets of tally sheets used in declaring election results for the post.
This was after Kasibante’s lawyer Elias Lukwago informed court that his client had asked for the same in the two letters dated 29th March and 4th April of this year but in vain to date.
Lukwago said he needed the tally sheets the EC based on to declare the victory of Kasibante and those it premised on to declare Singh winner so that he can be able to file the necessary affidavits after examining the various polling stations where results changed.
Justice Kibuuka Musoke has adjourned the case till the 3rd to be heard expeditiously up to 17th June.
Lukwago has appeared together Abdullah Kiwanuka while Simon Tendo Kabenge represented Singh.
Enos Tumusiime and Tom Magezi represented the EC.
Kasibante sued NRM’s Singh Marwahah Pamindah and the EC seeking for court orders to declare the election of Singh null and void and also compel the EC conduct fresh elections.
In the petition, Kasibante contends that the vote recount by the EC was illegal due to the high court order that had stopped the same.
The EC has declared Kasibante winner but after the vote recount, Singh was declared winner and Kasibante’s victory annulled.
Kasibante also wants the EC and Katongole to pay costs of the petition and any other relief court may deem fit and proper in the circumstances.
